1. Acceptance of Terms
By accessing or using the AXIOM network, application, website, or any related services (collectively, the “Service”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree, do not use the Service. AXIOM is developed by Clouthier Simulation Labs (“we”, “us”, “our”).
2. Nature of the Service
AXIOM is a decentralized, peer-to-peer messaging network. We do not control, store, or have access to your messages. The network is operated by independent node operators (Leaders). We provide the software and protocol; we do not operate the network infrastructure.
3. Open Source License
The AXIOM software is open source. The client application and network protocols are available under their respective open source licenses on GitHub. You are free to inspect, modify, and distribute the code in accordance with those licenses.
4. $AXM Token
The AXIOM network uses $AXM tokens to pay for message transmission and incentivize node operators. You acknowledge that:
- $AXM is a utility token for network operations, not an investment;
- Token value may fluctuate and you may lose value;
- We make no guarantees about token price or liquidity;
- You are responsible for securing your private keys and wallet;
- Lost private keys cannot be recovered by us or anyone else.
5. Genesis Leader Program
The Genesis Leader Program provides free $AXM tokens to early node operators. These tokens are subject to a 14-day vesting period. By participating, you agree to operate a node in good faith and not attempt to manipulate the network or claim multiple grants fraudulently.
6. Prohibited Uses
You agree not to use the Service to:
- Transmit illegal content or engage in illegal activities;
- Harass, threaten, or harm others;
- Distribute malware, spam, or phishing content;
- Attempt to attack, disrupt, or exploit the network;
- Circumvent security measures or attempt unauthorized access;
- Violate applicable laws or regulations.
While we cannot monitor or control content on the decentralized network, we reserve the right to take action against known bad actors where possible.
7. No Warranty
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR THAT MESSAGES WILL BE DELIVERED. THE NETWORK IS DECENTRALIZED AND DEPENDS ON INDEPENDENT NODE OPERATORS.
8. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, CLOUTHIER SIMULATION LABS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF TOKENS, DATA, PRIVACY, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE. THIS INCLUDES DAMAGES ARISING FROM NETWORK FAILURES, LOST MESSAGES, OR COMPROMISED SECURITY.
9. Your Responsibility
You are solely responsible for: securing your device and private keys; verifying recipient addresses before sending tokens; understanding the risks of decentralized networks; and complying with laws in your jurisdiction. We cannot reverse transactions or recover lost funds.
10. Governing Law
These Terms are governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts located in Ontario, Canada.
11. Changes to Terms
We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on our website with a revised date. Your continued use of the Service after changes constitutes acceptance of the updated Terms.
